Scottsdale Car Accident Lawsuit Settled for Two and a Half Times Initial Offer

This week, Scottsdale Injury Lawyers, LLC finalized the settlement of a car accident lawsuit filed on behalf of its clients. The car accident occurred in Scottsdale in 2015 when the driver of a vehicle failed to yield the right of way at an intersection. The failure to yield resulted in a significant impact at a high rate of speed. The firm’s clients were a mother and daughter, both of whom sustained concussions in the accident. The mother also sustained a neck injury.

When the insurance company refused to settle the case for a fair amount, Scottsdale Injury Lawyers, LLC filed a lawsuit on behalf of the clients. The firm filed the lawsuit in April 2017 in Maricopa County Superior Court and fought for more than one year to obtain the settlement. The insurance company defending the case claimed that a concussion was not a serious injury, that the clients could not have suffered concussions based upon the impact, and that the mother’s neck injury was a pre-existing degenerative condition not related to the crash.

The firm secured experts to testify on behalf of the clients as to both the scope of their injuries and causation. Through the firm’s efforts, the case was resolved for two and a half times what was initially offered. The primary attorney handling the case was Tony Piccuta. When asked about the result, Piccuta stated, “This was a hard-fought case that we put significant time and resources into. In the end, we are satisfied that we were able to increase the settlement offered to a reasonable amount. Most importantly, the client was happy with the result.”
