SIL Settles Car Accident Claim Against Amazon Driver

Unlike some other on-line retailers, Amazon delivers its own packages directly to consumers. In other words, when a customer orders from Amazon, Amazon is responsible for the entire sale process from order to delivery.
Other retailers may ship packages using carriers such as the postal service, UPS and FedEx. Amazon uses its own drivers and delivery agents to handle this process. Everyone has seen Amazon delivery vans driving around city streets and neighborhoods.
Car Accidents with Amazon Vans
Due to the sheer amounts of Amazon delivery vehicles on the road, car accidents with Amazon vehicles happen every single day. Delivery agents are tasked with delivering numerous packages and doing it within a certain period of time. As a result, Amazon delivery drivers may be rushing to deliver packages. They may drive too quickly for conditions and cause car accidents as a result.
Amazon Deliveries May Be Used As Evidence in Proving an Amazon Driver Caused a Car Accident
Amazon drivers typically take photos of the packages they deliver. They also have GPS systems tracking their coordinates. As a result, there is a paper trail of the packages they deliver including where and when. This evidence can be analyzed to determine if an Amazon driver was driving dangerously or in violation of the law.
For example, if an Amazon driver delivered a package at a certain location, someone could then track how much time passed until the next delivery. The distance and time between deliveries could be used to determine if that driver was speeding. This is just one way that Amazon delivery evidence can be used to help establish fault in a serious injury case.

The Recent Car Accident We Handled Against an Amazon Driver
In the recent case we handled, the Amazon driver was working for Amazon Logistics, Inc. The van she was driving was owned by Amazon Logistics, Inc. Amazon Logistics, Inc. has its principal location in Georgia. Amazon Logistics, Inc. employs drivers that deliver packages for Amazon.
The Amazon driver failed to yield at an intersection. As a result, the Amazon van crashed into our client causing him injuries. Police responded to the scene to investigate the crash.
The police concluded that the Amazon driver violated A.R.S. Section 28-771(A). This law applies to vehicles at intersections. This traffic law sets forth:
“When two vehicles enter or approach an intersection from different streets or highways at approximately the same time, the driver of the vehicle on the left shall yield the right-of-way to the vehicle on the right.”
The driver was cited at the scene for her violation of the law.
The Car Accident with the Amazon Driver Was Captured on Video
The client was driving a 2021 Tesla. His tesla had video recording capabilities. At the time of the crash, the Tesla video system was recording. The video system captured the crash and proved the Amazon driver was at fault. A video of the crash can be seen HERE.
The Specifics of the Amazon Van Accident
At the time of the collision, the client was not expecting the impact and was unable to brace for it. The Amazon van caused a forceful side-impact collision when the front of the van struck the driver side door of the client’s vehicle. The van was much heavier than the client’s Tesla. This caused his Tesla to be significantly displaced upon impact.
The client was thrust and whipped side to side inside his vehicle. There was nothing inside his vehicle to stop this abrupt left to right movement. Unlike a rear end car accident, where a headrest reduces the movement of an individual, there was no such protection stopping the client’s sideways momentum. As a result, the client’s neck and head moved violently inside the cabin upon impact causing significant injuries.
The Injuries Caused by the Amazon Delivery Van Accident
When the van crashed into the client, his neck and back were unable to withstand the forces without sustaining injury. Within hours of the crash, the client began experiencing headaches, neck pain and back pain. The client attempted to treat his symptoms with Ibuprofen and Tylenol.
Three days later, the client’s pain became unbearable and he sought medical treatment. He presented to his primary care doctor who performed a physical evaluation. The client was diagnosed with musculoskeletal injuries and prescribed physical therapy.
The client was ultimately diagnosed with the following:
- Sprain of ligaments of cervical spine S13.4XXA
- Strain of muscle and tendon of back wall of thorax S29.012A
- Sprain of ligaments of thoracic spine S23.3XXA
- Segmental and somatic dysfunction of cervical region M99.01
- Segmental and somatic dysfunction of thoracic region M99.02
The client needed sixteen physical therapy appointments to fully recover. Eventually, he regained full mobility and all pain symptoms subsided. However, during the period of time he was injured, he had to curtail his active lifestyle.
The Effect the Amazon Car Accident Had on the Client’s Life
The client lived a very active lifestyle prior to the accident and physical fitness was extremely important to him. In addition, he had two young sons aged 10 and 12. Prior to the accident, he would wrestle, play catch, throw balls and engage physically with his sons often.
Both of his sons played football and baseball. The client was their coach for both sports. After the accident, the client was forced to take a hands-off approach from coaching due to his pain.
Prior to the accident, the client exercised daily. He lifted weights 4 times a week and completed cardio workouts daily. Regular exercise was vital to his well-being and part of his regular activities of daily living. In the four to six months it took him to fully recover from the accident, he was unable to partake in these activities without significant limitations and pain.
The Settlement In the Amazon Car Accident Case
